Key Considerations After Acquiring Your Property in Spain
1. Non-Resident Tax Returns
If you do not intend to become a permanent resident in Spain, you may be caught off guard by the necessity of filing a non-resident tax return. Many clients who have owned properties for years overlook this obligation, which can lead to complications when the tax authorities take notice.
In Spain, as a non-resident, you are required to submit a tax return annually for each property you own.
For instance, if you possess both a townhouse and a finca in the countryside, you will need to file a separate declaration for each. Moreover, if you co-own the property with a partner or spouse, you will need to split the declaration equally between you for the tax year.
The Spanish Tax Year runs from 1st January to 31st December.
For non-rented properties, the tax return deadline is 31st December of the year following the tax year. For example, the 2024 tax return (Modelo 210) is due by 31st December 2025. If paying via Direct Debit, the deadline is 23rd December 2025.

2. Obtaining Your NIE Number
Your Foreign Identification Number, commonly referred to as an NIE, is essential for many transactions in Spain, including property purchases, opening bank accounts, and even buying a vehicle. It’s crucial to retain the original certificate issued when you receive your NIE, as it serves as your ID throughout your time in Spain and will be required frequently for various formalities.
3. Establishing an Official Notification Address
It is advisable to set up an official notification address. This address will be used for any official correspondence, particularly from tax authorities. If you’re not on the ground regularly, you won’t be able to claim ignorance regarding communications sent to this address, making it vital to sort out this detail promptly. 4. Understanding Tax Residency
A common query concerns the distinction between tax residency and residency itself.
Generally, if you spend over 183 days a year in Spain, you will be classified as a tax resident, which comes with obligations regarding tax declarations.
For foreigners outside the EU, applying for a visa may be necessary to establish residency. Understanding the difference between tax residents and non-tax residents is crucial, as you could inadvertently incur capital gains tax in Spain upon selling property elsewhere if you become a tax resident within the same year.
5. Rental Regulations
If you intend to rent out your property, be aware that the rules differ depending on whether you’re considering long-term or holiday rentals. In Andalucía, for example, holiday rentals require a specific tourist licence, which can restrict the duration you are allowed to let your property. Long-term rentals do not necessitate a licence, but you must ensure that your tenancy agreement complies with legal requirements.
